The White House released its National Policy Framework for Artificial Intelligence on March 20, 2026, and every CISO needs to read past the headlines. The document is not a law. It is not a regulation. It is a set of legislative recommendations directed at Congress — non-binding by design — outlining how the Trump administration believes the federal government should approach AI governance. What it is, practically speaking, is the clearest signal yet of where federal AI policy is headed and how that trajectory should reshape your organization’s approach to AI risk management, compliance planning, and governance program design.
The framework follows Executive Order 14365, signed in December 2025, which directed federal agencies to identify and challenge state AI laws that conflict with national AI strategy. Together, these actions set up the central tension that enterprise security leaders now have to navigate: a federal posture that is explicitly moving toward preempting state-level AI regulation, while the regulatory patchwork of existing state laws and enforcement authority remains fully intact in the interim.
Seven Pillars, One Direction
The framework organizes its recommendations around seven policy pillars. Each one has direct or indirect implications for how organizations govern AI. Some are straightforward compliance considerations. Others touch the security program more directly than they might appear at first read.
1. Protecting Children and Empowering Parents
The framework calls for eliminating the collection of children’s user data by AI systems and augmenting parental safety controls. It explicitly preserves state authority to enforce laws against child sexual abuse material, including AI-generated CSAM — this is one area where federal preemption does not apply. For organizations that operate consumer-facing AI products or deploy AI tools accessed by minors, this pillar establishes a clear compliance expectation: AI systems that touch children’s data will face heightened federal scrutiny, regardless of the outcome of the broader state preemption debate.
2. Safeguarding and Strengthening American Communities
This pillar positions AI-enabled fraud, impersonation, and scams — particularly those targeting seniors and other vulnerable populations — as a national enforcement priority. The framework calls on Congress to augment existing law enforcement capabilities to address these threats. For security leaders, this is relevant not just as a regulatory signal but as a threat landscape update. AI-enabled fraud and voice cloning attacks are already a significant social engineering threat against employees and customers. Federal prioritization of enforcement in this area signals that organizations should expect regulatory scrutiny if their AI-enabled customer interactions are exploited in fraud schemes without adequate controls in place.
3. Respecting Intellectual Property Rights and Creators
The IP pillar has three specific recommendations that enterprise legal and security teams should flag. First, the framework recommends letting courts resolve whether AI training on copyrighted material constitutes fair use rather than establishing a legislative standard — which means litigation risk in this area remains elevated and unresolved. Second, it recommends considering licensing frameworks that allow rights holders to negotiate compensation from AI providers without antitrust liability, creating a potential new category of contractual obligation for AI vendors. Third, and most immediately relevant to enterprise deployments, it recommends establishing federal protections against the unauthorized commercial use of AI-generated digital replicas of individuals’ voice or likeness. If your organization is using AI tools that generate synthetic voices or images of real people — for training, marketing, customer service, or any other purpose — this is a compliance area to begin reviewing now rather than after legislation passes.
4. Preventing Censorship and Protecting Free Speech
The free speech pillar has two distinct prongs. The first prohibits the federal government from coercing AI providers to restrict or require content based on political agendas. The second recommends creating a private right of action for Americans against federal agencies that attempt to censor or compel speech through AI platforms. For enterprise security leaders, the most relevant element of this pillar is the digital replica and deepfake provision, which appears here in the context of protecting individuals from unauthorized use of their voice or likeness — with explicit carve-outs for parody, satire, and news reporting. Organizations using AI-generated voice or synthetic media in any commercial context should treat this as a near-term compliance area to scope, not a future legislative concern to monitor passively.
5. Enabling Innovation and Ensuring American AI Dominance
This is the innovation-forward pillar and reflects the administration’s core philosophy: AI governance should enable U.S. competitive advantage, not hinder it. The specific recommendations include establishing regulatory sandboxes for AI testing and development, expanding access to federal datasets in AI-ready formats, and maintaining a sector-specific regulatory approach that relies on existing bodies rather than creating a new federal AI regulator. The explicit rejection of a new federal AI rulemaking body is significant. It means AI governance in the United States will continue to be distributed across agencies with different standards, enforcement philosophies, and sector expertise — which creates complexity for organizations operating across multiple regulated industries. A healthcare AI deployment, a financial services AI model, and a defense contractor’s AI tool will each face different regulatory expectations from different agencies, without a single unified framework to align to.
6. Educating Americans and Developing an AI-Ready Workforce
The workforce pillar calls for non-regulatory federal investment in AI training through existing education systems, additional study of AI’s effects on job displacement, and support for land-grant institutions delivering AI education programs. For enterprise security teams, the workforce development angle has a direct operational implication: the AI literacy gap between security professionals and the AI systems they are now responsible for governing is real and widening. Federal investment in AI education is a long-cycle solution. In the near term, CISOs need to accelerate internal upskilling programs to close that gap within their own teams before it creates blind spots in their governance programs.
7. Establishing a Federal Framework That Preempts State Laws
This is the pillar that has drawn the most attention and that creates the most immediate uncertainty for compliance programs. The framework’s position is direct: “Congress should preempt state AI laws that impose undue burdens to ensure a minimally burdensome national standard consistent with these recommendations, not fifty discordant ones.”
The framework draws a careful distinction, however, between state laws that would be preempted and state authority that would be preserved. States would retain the ability to enforce generally applicable consumer and child protection laws, regulate zoning and land use for AI infrastructure, and govern their own use of AI through procurement and public services. What would be preempted are state-specific AI regulatory regimes that create compliance burdens inconsistent with the federal approach — the growing body of state AI disclosure laws, algorithmic accountability requirements, and AI-specific liability frameworks.
The Compliance Uncertainty Problem
The framework is designed to reduce long-term compliance complexity by replacing a patchwork of state laws with a unified national standard. In the short term, it does the opposite. Organizations now have to navigate the existing state regulatory landscape while simultaneously monitoring federal legislative developments that could preempt that landscape at an uncertain future date. State attorneys general are not waiting for federal preemption to begin enforcement. Courts are adjudicating competing claims. And the federal agencies responsible for sector-specific AI oversight are developing their own interpretive frameworks without the benefit of new statutory authority.
This is not a situation where waiting for clarity is a risk management strategy. Compliance uncertainty is highest precisely when governance programs are weakest — and weakness in AI governance is what regulators, plaintiff’s attorneys, and adversaries exploit. The organizations best positioned to navigate this period are the ones that have built governance programs robust enough to satisfy the most demanding requirements currently on the table, because those programs will be at least as defensible under a future unified federal standard as they are today.
What CISOs Should Be Doing Right Now
The framework is a prompt for action, not a reason to wait. Four things deserve immediate attention.
First, update your AI inventory. The framework’s provisions touch virtually every category of AI deployment — generative AI tools, AI-enabled customer interactions, AI used in hiring and workforce decisions, AI systems that process personal data. If you do not have a current, comprehensive inventory of where AI is being used across your organization, you cannot assess your compliance exposure under any of the seven pillars, let alone across the full state regulatory landscape.
Second, scope your digital replica exposure. The unauthorized use of AI-generated voice or likeness is one of the most specific and near-term compliance areas the framework creates. Review your vendor contracts, your marketing and training content production workflows, and your customer service AI deployments for any use of synthetic voice or image generation. This area is headed toward explicit federal protection regardless of how the broader preemption debate resolves.
Third, assess your AI fraud controls. Federal prioritization of AI-enabled fraud against vulnerable populations means enforcement attention is coming to this space. Review your customer-facing AI interactions for spoofing and impersonation risk. Ensure your employee security awareness training has been updated to address AI-enabled social engineering, including voice cloning and synthetic identity attacks.
Fourth, engage your legal team on state law compliance now. The preemption question will not be resolved this quarter. Your organization needs to understand its current exposure under the state AI laws that apply to your operations and build a compliance posture that does not depend on preemption happening on any particular timeline. That posture should be documented, defensible, and auditable — because state enforcement is not pausing while federal legislation works through Congress.
The Bigger Signal
Behind the seven pillars and the legislative recommendations is a strategic direction that security leaders should internalize. The federal government has decided that AI dominance is a national security and economic imperative, and that governance frameworks which impede AI adoption are a problem to be solved rather than a legitimate risk management tool. The administration’s preference is for industry-led standards, existing regulatory bodies, and minimum-burden rules — not prescriptive federal AI regulation.
That preference does not eliminate the need for rigorous enterprise AI governance. It shifts the burden of proof. Organizations that deploy AI without robust governance programs will no longer be able to point to regulatory ambiguity as a reason for their gaps. Federal direction now exists, even if it is not yet codified in statute. The question regulators, auditors, insurers, and boards will increasingly ask is not whether federal AI law applies to your organization — it is whether your governance program reflects a reasonable and good-faith effort to manage AI risk in light of available guidance. This framework is guidance. The expectation that you have read it and acted on it is already in place.
